As a condition for the use of the service, you permit Racitelcom, Inc. to process and/or disclose personal data, including that data that may be classified as personal information and/or sensitive information under the Data Privacy Act of 2012, it’s partners and/or other third parties in order to undertake activities like the following among others:
1. Conducting analysis and research.
2. Account management
3. Statistical insight to assist the Government in planning for healthcare,
disaster, and the likes.
4. Sending commercial and promotional advertisements,surveys,customer-care,
after sales communications, and other broadcast push messages.
5. Such other processing or disclosure that may be required under the law or
regulations.
Your personal data will be maintained in our records throughout your availment of the service. You are afforded certain rights in relation to your personal data under the Data Privacy Act, including the right to object to processing, the right to access your data, the right to rectification of inaccurate data, and the right to erasure or blocking of data.
Racitelcom, Inc. will provide customer a copy of their monthly bill either via post or e-mail. If the subscriber encounters any error or discrepancy on the bill, the subscriber should notify the appropriate Racitelcom, Inc.’s department in writing within 7 days from the date bill was received. Specify which item or amount is affected. The subscriber shall cooperate and provide all the necessary information that will be requested by Racitelcom, Inc. for the investigation and verification of such claim.
The subscriber is liable to settle all charges including long distance and international charges originating from his/her telephone regardless who made the call, to whom the call was made, time of call, and duration of the call. All subscribers are should settle in full their outstanding balance on or before the due date indicated in the statement of account to avoid service interruption. Service restoration due to non-payment will be done within 24hours once payment is posted on the account.
In the event that the susbscriber did not receive any bill or the bill was delivered late, it is the responsibility of the subscriber to inquire about his/her total amount due by calling Racitelcom’s Billing Department during office hours and settle his/her bill at any of the payment centers.
Racitelcom, Inc. reserves the right to make changes to the pricing attuned to the times with due diligence.
7 Days Replacement Warranty
CPE (Customer Premise Equipment) that were legally purchased from and was installed by Racitelcom, Inc. that are deemed to have a factory or manufacturer’s defect without any physical damage may be replaced if reported within 7 days from the purchased date & confirmed by Racitelcom, Inc..
6 Months Warranty
Racitelcom, Inc. will try to repair non-functioning CPE if it is repairable except if the cause is an act of God. In the event that repairing the non-functioning CPE has failed or no longer possible Racitelcom, Inc. will not be held liable. Customer will need to purchase a new at this point.
These warranty excludes damages resulting from customer’s negligence, abuse, accident, mishandling, manipulation, acts of God, or any other damages not caused by factory or manufacturer’s defect. Any claim for replacement or repair after the warranty periods provided will not be honored. Other related items or equipment personally owned by the customer shall remain the property of the customer. Racitelcom, Inc. is not liable for the loss, damage, degradation, and will not repair or replace such items or equipment personally owned by the customer. Equipment, cables, computers, laptops, telephone sets, and other related items owned by the subscriber shall remain the property of the subscriber. Racitelcom, Inc. is not liable for the loss, damage, or item degradation, and will not repair or replace such items owned by the subscriber.
Customers are not allowed to use Racitelcom’s services for illegal purposes such as but not limited to any forms of toll bypass, reselling of voice and data circuits, allowing any other third party to use our services in any way, hacking our network in any manner, installation of illegal extensions, and other malicious activities that are against the law.
The subscriber shall be responsible for all web sites he/she visits and all software applications and files he/she downloads from the internet. Any of these that may affect the performance of the internet-enabled device or may divulge any personal information such as credit card details, bank account details or private files will not be the responsibility of Racitelcom, Inc..
Any equipment, cables or other items that provided and installed by Racitelcom, Inc. to the subscriber but was not purchased by the subscriber shall remain a property of Racitelcom, Inc. The subscriber shall have no property right these but only the permission to use them as stated in this contract. In the event that the equipment, cables or other items of Racitelcom, Inc. are damaged due to acts or omissions of the owner, guests or any persons allowed access by the subscriber to the premises where the equipment are located, the subscriber shall pay for the value of the damage suffered by Racitelcom, Inc. including replacement cost if necessary. In the event that the subscriber decides to terminate the service, Racitelcom, Inc. shall recover all of the facilities as stated on this paragraph.
When the following conditions are met, Racitelcom, Inc. has the authority to restrict or suspend specific client services for a specified time period:
1. The outstanding balance was not paid on or before the due date
2. The call credit limit has been reached
3. Upon examination, it was determined that the subscriber is or has broken one
or more of the terms and conditions.
I. Racitelcom, Inc. will only begin installation of the applied products and services when the subscriber has fully paid the installation expenses as well as the pre-requisites.
II. If the applicable products and services need the use of a power source, the subscriber must be able to provide his or her own supply of 220 VAC commercial power.
I. The contract period for the purchased items and services is 24 months from the date of service installation
II. Service Cancellation
In-Contract. If the subscriber wishes to cancel the service before the contract period expires, the subscriber must pay the remaining number of months until the contract term expires multiplied by the Monthly Service Fee before the Service Order for the disconnection is created.
Out of Contract. If the subscriber desires to discontinue the applied service, a disconnection application must be made at least two (2) months prior to the actual date of disconnection.
III. Upgrade can be done at any time. There should be no balance on the account. This will also result in the contract being renewed
IV. Downgrade
In-Contract Downgrade. If the subscriber's account is still under contract, there is no way to downgrade.
Out of Contract Downgrade. The subscriber will just have to pay the downgrading charge, which will also renew the contract. A corresponding fee will be charged.
V. Service Relocation. This is something that can be done at any moment. The account should have no balance. Prior to establishing a service order, the subscriber will pay a matching relocation charge + extra span for the cable based on the kind of service (the first 150 meters of cable are free). This will result in the contract being automatically renewed.
VI. Change Name. This can only be done after the account has been released from contract and there is no balance on the account. There will be a cost for this. This will also result in the contract being renewed.
VII. If the subscriber was disconnected by Racitelcom, Inc. due to non-payment of an outstanding balance or a violation of the Terms and Conditions, the subscriber will be obligated to pay all charges plus the Monthly Service Fee multiplied by the number of months remaining before the contract term expires.
VIII. The two-month Advance Security Deposit for DSL and FTTH is non-refundable; it may only be utilized if a service termination order is issued. To be used within the last two months of the billing cycle.
